The terms that apply to the use of the app “Fruit Fusion”.

1. Scope

By downloading and using the app “Fruit Fusion” (the “app”) you accept these Terms of Use. The
provider is Emanuel Berger, Bgm.-Gruner-Str. 10, 85250 Altomünster, Germany.

2. Scope of use

The app is made available to you free of charge for private use. The acquisition of the app through
an app store and any mobile or data transfer costs are governed by the terms of the respective store
operator (Apple or Google).

3. Advertising

The app is funded by advertising. Ads are personalised only with your consent; without consent you
will see non-personalised ads. Details are set out in the
Privacy Policy.

4. “Remove Ads” purchase

A one-time in-app purchase lets you remove ads permanently. The purchase is processed by Apple or
Google and may be refunded under their terms. It is tied to your Apple or Google account and can be
restored at any time via “Restore purchases” in the app’s settings.

5. Availability

We work to keep the app free of errors and available, but we do not owe uninterrupted operation. We
may further develop, change or discontinue the app.

6. Your obligations

You must not manipulate or modify the app, decompile it, or use it in any way that infringes the
rights of third parties or violates applicable law.

7. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or
health. For simple negligence we are liable only for the breach of essential contractual obligations
and limited to the foreseeable damage typical for this type of contract. Otherwise liability is
excluded.

8. Governing law

German law applies. Mandatory consumer protection provisions of your country of residence remain
unaffected.

9. Changes

We may adjust these Terms of Use when the app is further developed or the legal situation changes.
The version published at this address applies.
